Terms of Use for Customers

Before you use or access the services, take the time to carefully review these terms and conditions. They hold crucial details about your legal rights, duties, and the remedies at your disposal concerning your use of Bodysync Hub's services. Within, you'll find specific limitations and exclusions that apply.

1. Introduction

Welcome to Bodysync Hub AB ("Bodysync," "BOSY," "Company," "we," "our," or "us"). These Terms & Conditions govern your use of our Whole Body Electro Muscle Stimulation (WB-EMS) services and our website and digital services. By accessing or using our services or website, you agree to comply with these Terms & Conditions and our Privacy Policy, as well as the Customer’s Consent when using our services. If you do not agree with these terms, please refrain from using or signing up for our services and using our website and applications.

2. Usage of Services

As a Member, you agree to the following conditions:

2.1. Be in good health as required by Bodysync, ensuring no apparent risk to your health and safety.

2.2. Have no outstanding payments or debts to previous Bodysync services.

2.3. Not have been banned from any Bodysync facility or engaged in inappropriate behaviour.

3. Memberships and Series

3.1. Memberships or series are valid from the purchase date unless specified otherwise in the Subscription Agreement or on the website.

3.2. Active subscriptions continue until termination according to the Termination chapter below.

3.3. Prepaid memberships, series, or expired passes are non-refundable.

3.4. Memberships are private and cannot be transferred or used by anyone other than the Member.

3.5. Memberships allow training at one or more Bodysync facilities, unless specified otherwise.

3.6. Members have access to available offers subject to applicable terms.

3.7. Additional series can be purchased at the same price as offered on the website.

3.8. Monthly subscription upgrades are possible at any time, with the price difference paid upon upgrade.

3.9. Downgrades of monthly subscriptions can be requested for the following month but not for prepaid or fixed memberships or series.

3.10. Members with outdated memberships will be transferred to new offerings upon renewal or change.

4. Studios and Availability

4.1. Bodysync cannot always guarantee space availability for training or similar limited-spot activities.

4.2. Adjustments to offers, locations, or hours may occur based on Member preferences, and closures might happen during holidays, vacations, maintenance, or Force majeure.

4.3. Camera surveillance may occur in training facilities for security and insurance, excluding certain spaces such as changing rooms, toilets and showers.

5. Discounts

5.1. Bodysync offers discounts in campaigns or for specific groups or organisations, subject to termination without prior notice.

5.2. Discounts cannot be combined for series or membership agreements.

6. Purchase of Series

6.1. All series available on the website can be purchased either through our partner Bokadirekt or directly in our studios during your visit. However, it is mandatory that your subsequent visit is prepaid.

6.2. If a Member purchases their series online through our vendor Bokadirekt, the right of withdrawal as per the Swedish "Distance and Off-Premises Contracts Act" does not apply. Exceptions to this law are detailed in Chapter 2, Paragraphs 1§ and 11§.

6.3. The right of withdrawal does not apply if the Member has purchased their series directly from one of Bodysync’s physical studios.

6.4. Prior to purchasing any series, the Member must ensure their good health status and confirm eligibility to train with WB-EMS. Bodysync holds no responsibility if the Member fails to adhere to this rule, thus forfeiting entitlement to a refund.

6.5. Should a Member accumulate more than 10 series and, due to unforeseen and severe health conditions listed as contraindications in our Customer’s Consent, become incapable of training with EMS upon presentation of a doctor’s notice, they may request a refund for the remaining classes.

6.6. Additional Terms & Conditions may be applicable through our vendor Bokadirekt.

7. Member's Responsibilities

Members must:

7.1. Adhere to safety protocols and guidelines outlined by Bodysync.

7.2. Completely understand and sign the Customer’s Consent before the first WB-EMS training session.

7.3. Disclose any health conditions not outlined in the Customer’s Consent that may impact the safe use of Bodysync’s equipment and seek advice from a qualified medical professional if necessary.

7.4. Immediately notify Bodysync of changes in health conditions post-signing of the Customer’s Consent that might affect the safe use of Bodysync’s equipment.

7.5. Refrain from using any performance-enhancing substances. Bodysync defines doping according to World Anti-Doping Agency (WADA) criteria and reserves the right to conduct random tests. Member consent is required for such tests, conducted under specific protocols disclosed to the Member and supervised by an authorised third party.

7.6. Immediately inform Bodysync of any changes in personal or payment details, including alterations in name, address, email, phone number, account information, or any other relevant data provided.

7.7. Promptly inform Bodysync of any circumstances that might disqualify you from accessing discounted membership or series privileges.

7.8. Upon request, present a valid identification document with a photo (Driver's License, National ID, Passport, or Student Card).

7.9. Respect Bodysync's cancellation policy by providing a minimum of 24 hours’ notice before canceling or rescheduling any scheduled training session. Failure to comply will result in full compensation owed to Bodysync, deducted from purchased series or charged in ongoing membership agreements.

7.10. Keep personal login details, identity documents, and access-related information confidential. Sharing this information is strictly prohibited and may result in immediate termination of the agreement with Bodysync without notice or refund. In such an event, the Member will be banned from accessing Bodysync premises and registering for any future Bodysync services.

8. Injuries, Storage, and Liability

8.1. Members acknowledge that exercising with WB-EMS is at their own risk. Bodysync is not liable for any personal injuries incurred during their stay or participation in activities at Bodysync facilities, including other training offers, services, or consultations.

8.2. Bodysync bears no responsibility for theft or loss of Members' personal belongings stored at facilities. If forgotten, Members must retrieve their possessions within two weeks, irrespective of their storage method or location on Bodysync premises.

9. Termination

Bodysync reserves the right to terminate or suspend access to services or the website at any time without prior notice for violation of these Terms & Conditions or applicable laws.

10. Handling of Personal Data and Communication

By signing up for our services, Bodysync will process personal data about the Member. More details on data processing and Member privacy rights are outlined in our Privacy Policy on our website.

11. Intellectual Property

All content, trademarks, logos, and materials on our website are the property of Bodysync Hub and XBody and are protected by intellectual property laws.

12. Liability Limitation, Jurisdiction, and Dispute Resolution

12.1. Bodysync is not liable for disruptions or constraints hindering training offerings due to circumstances beyond its control (Force majeure), such as natural disasters, epidemics, political conflicts, or war.

12.2. Efforts will be made to amicably resolve disputes. If unsuccessful, the Member may refer the matter to the Swedish General Complaints Board (Allmänna Reklamationsnämnden). Both parties retain the right to seek resolution through regular court proceedings.

12.3. In cases of disparities between the Swedish version and other language versions of the Membership Agreement, precedence shall be given to the Swedish version.

13. Changes to Terms and Conditions

We reserve the right to modify these Terms & Conditions without prior notice. Your continued use of our services or website after any modifications indicates acceptance of the updated Terms & Conditions.
